<p>So often people can feel like they&#8217;re just a number or just a transaction, which is why the Hardship Letter is so valuable in humanizing your situation.  It is <strong>usually 1-2  pages in length and explains in detail what is going on with the homeowner</strong>.</p>
<p>The reason the hardship letter is <strong><em>so</em></strong> important is that it <strong>allows the lender to get to know the homeowner and their situation</strong>.  Each situation is different &#8211; as we all know &#8211; and this letter is the opportunity to explain that to the lender.  Some of these factors include:</p>
<ul>
<li> loss of employment</li>
<li>reduction in income</li>
<li>illness</li>
<li>death in family</li>
<li>increase in mortgage payments because of negative amortization loans</li>
</ul>

<p>Let&#8217;s say you&#8217;re in this predicament: <strong>what do you write?</strong></p>
<p>Don&#8217;t worry &#8212; you&#8217;re not the only who&#8217;s felt overwhelmed or just stuck when it comes to what to include in the Hardship Letter.  Which is why I&#8217;m providing you with an example.</p>
<p>This is meant as a guide for you, should you be in the position to need to craft a Hardship Letter.</p>
<blockquote><p><strong>To Whom it May Concern:</strong><br /></br><br />
<strong>I am writing this letter to express my need for having to sell my home as a short sale.   I never thought I would be in a position where I would have to do this but regrettably I am.  I purchased this home in the spring of 2007 when the market was at its highest for $3,895,000.  Since that time the housing market has dramatically dropped in my area as in the rest of the country.  I find myself in the situation where a lot of people are right now, which is that I owe more than my home is worth.</strong><br /></br><br />
<strong>In addition, my financial situation has dramatically changed as well.  When I purchased this home I was getting roughly about $90,000 a month in income.   Now I am getting roughly $30,000 a month. With my mortgage and all my other expenses, it is a struggle to barely break even each month.</strong><br /></br><br />
<strong>On top of all that I have stated above, this past summer I recently had a very serious health crisis and it has put me even deeper in the hole with my medical bills.  I need to simplify my life right now and the stress of trying to keep up with my mortgage is too much for me.</strong><br /></br><br />
<strong>I have been a very good client of Chase, never missed a single mortgage payment, and my credit is impeccable.  I am asking you to please work with me and help me in this situation.<br />
</strong></p></blockquote>
<p><strong> </strong></p>
<p>This document is <em><strong>crucial</strong></em> for the lender to understand why a short sale is necessary, so the more detailed you can be the better.  Be honest and thorough &#8212; this is your chance to truly explain your hardship &#8212; hence the name!</p>

<p><strong>1. Trust yourself</strong>. </p>
<p>How do you trust yourself? Honor your word. I have challenged those that work with me at Partners Trust to &#8220;speak only the truth with every word that comes out of your mouth.&#8221; Don&#8217;t make a commitment you are not willing to back up, don&#8217;t say you&#8217;ll be somewhere knowing full well you are not going to show up. Say it and do it. Because in all candor, if you don&#8217;t trust yourself, how can you possibly ask others to trust you?</p>
<p><strong>2. Share your passion for excellence</strong>. </p>
<p>How many times have we been told words to the effect of, &#8220;Do what you love and the money will take care of itself&#8221;? The quality of your life &#8212; not the quantity &#8212; defines the degree to which you enjoy it. So, in terms of real estate as a career, ask yourself:</p>
<p><strong>~ Do you love homes and architecture?<br />
~ Do you love strategy and negotiation techniques?<br />
~ Do you enjoy people and engaging with them in meaningful ways,<br />
        both intellectually and in play? </strong></p>
<p>Forget whether or not in this moment you think you are &#8220;good&#8221; at any or all of these elements. Simply put, do you enjoy the prospect of learning how to be better in these capacities? If so, fantastic, because that&#8217;s all you need to get started. In my experience, most of those who get into Real Estate just for the money end up frustrated and negative. No thanks.</p>
<p><strong>3. Be Bold in the way you share your vision of service</strong>. </p>
<p>Real Estate is a &#8220;people&#8221; business. You thrive because you have many clients that trust you and &#8220;get&#8221; your caring for them (see points 1 and 2).  We live in a very transparent world. The internet exposes us all &#8212; so take full advantage of the opportunity. For those of you who already engages in social networks, you are well on your way to executing this third stage of success. A friend of mine gave me a great perspective on the perceptions of some who are born into wealth, &#8220;Yeah, the guy was born on third base and thought he&#8217;d hit a triple.&#8221; </p>

There are many emotions involved with being a part of the short sale process &#8211; especially if you are the one in the “hot” seat.</p>
<p>Having represented several sellers in the process of short sales, I&#8217;ve noticed the same questions and concerns brought up by nearly every one of them.  This situation can be stressful and confusing, which is why it&#8217;s best to have a <strong>seasoned real estate professional</strong> to guide you through this to make things as calm and easy as possible.</p>
<p>I&#8217;m going to go through each of the top questions that I&#8217;ve encountered and help shed some light on the seemingly mysterious-yet-not-very-complicated process.</p>
<h2>
<p style="text-align: center;"><strong>“What exactly is a short sale and do I qualify?”</strong></p>
</h2>
<p><strong>A short sale is when you sell your house for less than what you owe on it. </strong> There is no guarantee that you will qualify for a short sale; so, what you need to do first is hire an agent &#8212; preferably one well-versed in selling homes through short sales &#8212; to put your house on the market and try to get a <strong>fair market offer</strong> for the sale of your home.</p>

<p>While your agent is trying to get an offer, you need to generate a <strong>hardship letter</strong> of why you need to sell your home. For this you will need:</p>
<p style="padding-left: 30px;"><strong>1)     Six-months of bank statements</strong></p>
<p style="padding-left: 30px;"><strong>2)     The last two years of tax returns or extensions and</strong></p>
<p style="padding-left: 30px;"><strong>3)     Either three-four months worth of pay stubs or a six-month profit and loss, if you are self-employed.</strong></p>

<p>Once the offer is made, the agent will submit it to the bank &#8211; along with the documents listed above &#8211; to start the short sale approval process.  In this time &#8211; if all is in order &#8211; the bank will then order their own appraisal.  If the appraisal comes in close to the offer, the chances of you getting approved are very good.  If the bank’s appraisal is more than the offer, than this is where the negotiation takes place.</p>
<p><strong>When an agreement is made between the bank, buyer, and seller, the bank will draft an approval letter and the escrow will begin</strong>. This process pretty much goes juts like a standard sale at this point. Short sales usually take anywhere between 60- 90 days, so patience is absolutely key during this stage of the process.</p>

<p>Let me tell you something about mixing business with pleasure:  </p>
<p>We are often asked during the course of our day, &#8220;How’s it going?”  A simple and rather innocuous question on its face and yet, when asked in relation to <a title="Partners Trust One of the Best Places to Work in LA" href="http://www.losangelesrealestatevoice.com/blog/partners-trust-selected-75-places-work-los-angeles-2010/" target="_blank">our new company that is now one year old</a>, the <strong>answer is far more intricate</strong>.</p>
<p>Taking a moment to gather my wits around the vast array of possible answers, I settle for, &#8220;<strong>exhilarating and exhausting</strong>.&#8221;</p>
<p>For starters, we are about to <a title="Partners Trust Beverly Hills" href="http://losangelesrealestatevoice.com/westsidenewconstruction/blog/mad-men-campaign/" target="_blank">open our second office in Beverly Hills</a> while simultaneously mounting a magnitude of new concepts and ideas all designed to make us stronger, better, and faster than our competition. Clearly, we are transcending the concept of simply surviving our first year to actually <em>thriving</em> as we launch into year two.</p>
<p>But, I really want to talk about <strong>the fun we’re having</strong> and how we can <strong>use our real estate platform to spread more humor</strong> as we reach out to our global audience.  (It&#8217;s true that <strong>you can mix business with pleasure, after all!</strong>) And what better way to do it than with the premier talents of <a title="George Segal" rel="imdb" href="http://www.imdb.com/name/nm0001719/" target="_blank">George Segal</a> and <a title="Richard Benjamin" rel="imdb" href="http://www.imdb.com/name/nm0000907/" target="_blank">Richard Benjamin</a>.</p>

<p>I had this idea for a comedic short video that would inspire laughs while also providing <strong>valuable tips for anyone looking to sell their home.</strong> I started by showing George two pages of dialogue that set the table for the piece, never in my wildest dreams imagining that he’d actually want to be a part of it. Well, silly me, he started laughing right away and from there we were off to the races. Everyone contributing their talents &#8212; improvising, laughing, brainstorming. The creative process was a blast.</p>
<p>So, now we invite you to take a look at our first video in what could become a series &#8212; if popular demand yearns about what <strong>really goes on when a home seller and a real estate broker get together to talk about pricing a home.</strong> We hope you enjoy it.</p>

<p>Venice gave birth to a <a href="http://en.wikipedia.org/wiki/Z-Boys" target="_blank">skateboarding revolution</a>, numerous <a title="Venice Mural Paintings" href="http://veniceartwalls.com/" target="_blank">artistic movements</a>, and an <a href="http://intotheloop.blogspot.com/2008/06/venice-beach-architecture.html" target="_blank">architectural housing</a> boom – it’s rare to find a “new” happening in this beach town. However, I was lucky enough to <strong>experience something completely new</strong>: the first ever <a title="Venice Art Crawl" href="http://veniceartcrawl.com/" target="_blank">Venice Art Crawl</a>.</p>
<p>The Venice Art Crawl was designed to be a monthly get together for local artists and galleries to showcase their artwork in a <strong>lively, community driven forum</strong>. One of the unique parts of the Art crawl is that it is held at all different sorts of venues along the <a href="http://www.venicebeach.com/" target="_blank">Venice Boardwalk</a> from art galleries to restaurants, hotels and even bike shops.</p>
<p>Now you might be saying, “Wait a minute, Venice already has a monthly get together centered around art: <a title="First Fridays" href="http://www.losangelesrealestatevoice.com/blog/venice-fridays-art-food-abbot-kinney-month/" target="_blank">First Fridays</a>.” While it is true that the basic premise of both is similar, anyone who has been to First Fridays recently knows it has become much more about <strong>food trucks</strong>, <strong>dinners at expensive restaurants</strong>, and <strong>tourists</strong> taking in Abbot Kinney than it is about art. Which is fine &#8211; don’t get me wrong &#8211; I regularly go to First Fridays and always have a great time, but it seems now that <strong>art is more of an after thought than the driving force</strong>.</p>
<p><img class="alignleft size-medium wp-image-2826" style="margin: 5px;" title="Venice Art Crawl" src="http://www.losangelesrealestatevoice.com/wp-content/uploads/2010/08/Venice-Art-Crawl2-300x196.jpg" alt="Venice Art Crawl" width="300" height="196" />That’s why I feel the Venice Art Crawl <strong>fills a much-needed niche</strong>: <em>A monthly celebration showcasing artists and local galleries along the most recognizable stretch of Venice: the Boardwalk.</em></p>
<p>Just the mere night of the week that the Art Crawl is scheduled for is a clear <strong>representation of its intention</strong>. On a Thursday night the most likely demographics are serious <strong>art enthusiasts</strong> and <strong>local residents</strong> from Venice looking to peruse the various collections on display. The vibe at the first Art Crawl reflected that.</p>
<p>Most exhibits weren’t overly crowded but had steady traffic of people admiring the different works of art. Most people came in small groups who mingled while they waltzed from exhibit to exhibit. <em>I even saw a couple of beautiful paintings sell to enamored crawlers</em>.</p>
<p>I really enjoyed the Art crawl. I went with a few friends and just biked from event to event, taking it all in. My favorite exhibit was the <a href="http://cavegalleryblog.blogspot.com/2010/08/on-thursday-aug-19th-very-first-venice.html" target="_blank">C.A.V.E. Collection</a> at <a href="http://www.jamesbeach.com/" target="_blank">James Beach</a>. The art was outstanding, <strong>the ambiance was fun and intimate</strong>, and, best of all, they had an artist working on a piece for all to see.</p>

<p>The events on the boardwalk were very unique as well. <strong>Seldom do I venture down the boardwalk at night</strong>, but it was encouraging to see small exhibits displaying their collections to passer-bys and having a lot of success. <a href="http://www.facebook.com/video/video.php?v=733797985858&amp;ref=mf" target="_blank">One exhibit in particular</a> was rocking with a DJ and a big crowd of people.</p>
<p><a href="http://jdvhotels42-px.trvlclick.com/hotels/losangeles/erwin" target="_blank">Hotel Erwin</a> was a popular destination during the evening with <strong>5 separate exhibits</strong> headlined by the <a href="http://mediaserver.vrxstudios.com/flash/app/flashviewer.htm?id=20468.86073&amp;template=126&amp;width=572&amp;height=667#" target="_blank">Dogtown Sweet’s</a> showcase with the Boys and Girls Club and the Historical Society’s collection of vintage Venice photographs at <a href="http://jdvhotels42-px.trvlclick.com/dining/losangeles/high" target="_blank">High</a> – the rooftop bar with spectacular views.</p>
<p>I would count the first Venice Art Crawl as a success and would expect it to become a permanent fixture on Venice’s already crowded social calendar. Make sure you get out and experience it next month!</p>

<p>In fact, according to <a title="LA Times California Short Sales" href="http://articles.latimes.com/2010/aug/11/business/la-fi-short-sales-20100811" target="_blank">the LA Times</a>, &#8220;California leads the way in deals in which lenders accept less than they&#8217;re owed.  Home short sales have tripled in the Sunbelt state since 2008.&#8221;</p>
<p>Because of the current economic conditions and the fact that homeowners are owing more on their homes than what they are worth, <strong>short sales are becoming more and more appealing to investors and banks</strong>.  Short sales are a cheaper way out than foreclosure for everyone involved.</p>
<p>The truth is that banks really do not want to foreclose on you.  If they can do a <a title="What is a Short Sale?" href="http://www.youtube.com/watch?v=39jr9GSIoxk" target="_blank">short sale</a> and it make sense fiscally, then the banks will do it because the banks want to try and recover as much as possible.  <strong>When a bank forecloses on a property, it costs them at least $50,000</strong> once you add up all of the legal fees, upkeep, and other costs.</p>
<p>But i<strong>n a short sale, the banks and investors will recoup at least 70-80 percent of their mone</strong>y.  This is unlike a foreclosure where sometimes the banks get less than half of what they are owed.</p>
<p>Now is a much better time than in 2008 when it was very tough for banks to do these sales.  <a title="LA Times Short Sales California on the Rise" href="http://articles.latimes.com/2010/aug/11/business/la-fi-short-sales-20100811" target="_blank">According to the same LA times article</a>, &#8220;there&#8217;s some regulatory pressure to get stuff off the balance sheet. And  lenders are less in denial now, coming to grips with the reality that  the economy isn&#8217;t going to snap back.&#8221;</p>
<p>On top of that, short sales could actually end up <em><strong>boosting</strong></em> the job market for a couple of reasons:</p>
<ol>
<li>Unemployed homeowners who can escape underwater mortgages have an easier time moving around, which allows them to then expand their job search.</li>
<li>Also, <strong>short sales take a softer hit on your FICO score </strong>than foreclosures, meaning that you&#8217;re most likely able to purchase another home within 18 months of the transaction, which is drastically different from a foreclosure which could affect your ability to buy a house for up to seven years.</li>
</ol>
<p>In essence, short sales are here to stay for the foreseeable future and homeowners should not be ashamed or embarrassed if they find themselves in a situation where they have to short sale their home.<br />

<p>However, once the papers have all been signed and you are in your new house, <strong>you do not want any surprises</strong>.  Not <span style="text-decoration: underline;"><em>one</em></span>.</p>
<p><img src="http://www.losangelesrealestatevoice.com/wp-content/uploads/2010/08/nickthreefingersuphomeinspections-300x255.jpg" alt="Nick Segal, President Partners Trust" title="Nick Segal, President Partners Trust" width="200" height="170" class="alignright size-medium wp-image-2790" />Therefore, I believe that it is incredibly important to do your due diligence and <strong>obtain <span style="text-decoration: underline;">all</span> of the necessary home inspections</strong>.  You do not want to find the mold under the carpet near the water heater, or the termite-infested structural beam after you have entered escrow!</p>
<p><strong>What are the recommended home inspections, and when do you order them?</strong></p>
<p>Ask your licensed real estate professional to provide you with a variety of qualified inspectors from which to choose. Meanwhile, here are the home inspections that I normally get when I buy a home:</p>

But even <strong>in the last ten years, online live chat has grown up</strong>.</p>

<p><a title="Streets to Homes Program Venice" href="http://www.yovenice.com/2010/08/05/ktla-on-streets-to-homes-presentation-flap/" target="_blank">Rosendahl has developed the program Streets to Homes</a> which he believes will keep both sides of the parking divide happy. In theory it’s a good idea; however, his solution shows his lack of knowledge with <strong>what is really happening in Venice</strong>.</p>
<p>The idea behind <em>Streets to Homes</em> is to <strong>rent parking space in Venice</strong> and move people living out of their cars in Venice off the streets into the controlled area.  After the move, a non-profit medical group will assist the homeless in finding them <strong>low income housing</strong> to get them off the street.</p>
<p style="padding-left: 30px;">Sounds like a good plan in an ideal world right? It’s the type of plan that puts a smile on your face and say “Yeah, that’s helping our community!” But after reading the <a href="http://www.venicestakeholdersassociation.org/" target="_blank">Venice Stakeholders Association’s rebuttal</a> to Rosendahl’s plan, I realized the plan is <strong>not well thought out</strong>, in any sense.</p>
<p>The first thing that the <em>Streets to Homes</em> program assumes is that the homeless living out of their cars want to find permanent housing. <strong>In Venice this is just not the case</strong>. The vast majority of the people living out of their cars are doing so because they want to: it’s a <em>lifestyle choice</em>.</p>
<p style="padding-left: 30px;">As a Venice resident recently noted on my blog last month, there are people <strong>who fall on hard times</strong> and are forced to live out of their cars until they get back on their feet. However, this represents a minuscule minority of the homeless in Venice who, in large part, prefer to live out of their cars. Therefore, how successful is this program going to be if the <strong>help the non-profit is offering is not wanted</strong>?</p>
<p>Another problem with this plan is that it is aimed towards helping homeless families find affordable housing. Unfortunately, the homeless population in Venice does not consist of many families. As the Venice Stakeholders Association puts it: “Out of over 250 documented occupied vehicles, <strong>residents know of only one family</strong>, a single mother with two teenage children (<em>who has rejected an offer of affordable housing</em>).”</p>
<p><img class="alignleft size-medium wp-image-2758" style="margin: 5px;" title="Streets to Homes Venice" src="http://www.losangelesrealestatevoice.com/wp-content/uploads/2010/08/Streets-to-Homes-Venice-300x211.jpg" alt="Streets to Homes Venice" width="300" height="211" />A <a href="http://www.laweekly.com/2010-07-22/news/gentry-against-funky-in-venice/" target="_blank">survey of the homeless</a> conducted by the St. Joseph Center also notes that out of the 84 people they found living out of their cars in Venice, the <strong>average age was 49 years old </strong>and most suffer from some sort of <strong>mental illness</strong>. Not exactly a family demographic. We can all agree this is a segment of our community that is in need of help, yet corralling them into a parking lot to try to move them into low income housing, is <strong>just not a smart idea</strong>, let alone a fiscally prudent approach.</p>
<p>Rosendahl has suggested that a non-profit medical organization be in charge of the <em>Streets to Homes</em> program (presumably either the <a href="http://www.venicefamilyclinic.org/" target="_blank">Venice Family Clinic</a> or the <a href="http://www.stjosephctr.org/" target="_blank">St Joseph Center</a>). While a medical NPO may be qualified to help the homeless’ mental disorders (which may be what they need more than housing), they <strong>will not be qualified</strong> to help find and move the homeless to affordable housing.</p>
<p style="padding-left: 30px;">I applaud Rosendahl for making an effort to solve this increasingly controversial problem, but this plan just <strong>isn’t going help anyone</strong>. The homeless aren’t going to want to be moved and Venice homeowners will only be <em>further enraged</em> that their tax dollars are being wasted on a program that doesn’t solve the issue that affects them.</p>
<p style="padding-left: 30px;">You have to feel a bit of <strong>sympathy</strong> for the homeless living out of their cars. You can tell they are trying to stay out of everyone’s way by parking near industrial zones and parks and I’m sure they are aware of the raging controversy swirling around them.</p>
<p>However, Venice is a largely residential area, so the homeless <strong>will always come into contact with homeowners</strong>. When I was taking the photos for this post near <a href="http://www.greatschools.org/california/venice/1950-Broadway-Elementary-School/" target="_blank">Broadway Elementary</a>, <a href="http://www.greendot.org/venice/" target="_blank">Venice Charter High</a>, and <a href="http://www.laparks.org/dos/reccenter/facility/oakwoodRC.htm" target="_blank">Oakwood Park</a>, there were about 10-12 campers and RVs that were being lived out of. What Venice resident would <strong>feel completely comfortable</strong> letting their kids walk to school or play in the park knowing that so many homeless are living right there?</p>
